The terms “we,” “us,” and “our” refer to Grufo. Grufo operates this online store and website at grufo.store, including all related information, content, features, tools, products, and services, to provide you, the customer, with a curated shopping experience collectively referred to as the “Services.”

Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when you access or use the Services.

However, the colors and appearance of a product may vary slightly depending on:

  • Normal variations in materials and manufacturing.

Grufo is a plush product. Minor variations in fur direction, stitching, shape, measurements, facial positioning, color, texture, or filling may occur between individual units and are not necessarily considered defects.

Product measurements are approximate. Because Grufo is soft and flexible, its dimensions may vary slightly depending on how the product is positioned or measured.

Products may arrive compressed due to protective packaging and shipping. The plush may require gentle reshaping after being removed from its packaging.

We do not guarantee that every product will appear exactly identical to photographs, digital renders, videos, advertisements, or other representations displayed through the Services.

Product descriptions, specifications, packaging, availability, and pricing may be modified without prior notice.

We reserve the right to:

  • Discontinue a product at any time.

  • Limit the quantity available for purchase.

  • Limit sales to particular people, regions, countries, or jurisdictions.

  • Refuse orders that appear intended for unauthorized resale.

  • Modify product packaging or included materials when reasonably necessary.

Any offer for a product made through the Services is void where prohibited by law.

Nothing in this section limits any mandatory rights or legal guarantees available to consumers under applicable law.

When you submit an order, you are making an offer to purchase the products listed in your order.

Receiving an order confirmation does not necessarily mean that the order has been finally accepted. It confirms that we have received your order request.

  • Grufo confirms that the order can be fulfilled.

  • Incorrect or incomplete customer information.

  • Shipping restrictions.

  • Unusually large quantities.

  • Suspected commercial resale.

  • Technical or payment processing errors.

If we cancel or modify an order, we will attempt to notify you using the email address, telephone number, billing information, or other contact information provided during checkout.

If payment has already been collected for an order that we cancel, the applicable amount will be refunded to the original payment method.

Please review your order carefully before submitting it.

Once an order has entered preparation, fulfillment, or shipping, we may be unable to cancel it or modify:

  • The product.

  • The selected size.

  • The quantity.

  • The delivery address.

  • The recipient information.

The price charged for a product will be the price displayed when the order is submitted, subject to the correction of genuine errors as permitted by applicable law.

The final order amount will be displayed during checkout and in the order confirmation.

Payments may be processed by Shopify Payments or other third-party payment providers. Grufo does not necessarily receive or store your complete payment card information.

Your financial institution or payment provider may charge currency conversion, international transaction, or other fees. These charges are determined by the financial institution or payment provider and are not controlled by Grufo.

SECTION 5 — SHIPPING AND DELIVERY

Shipping and delivery dates are estimates and are not guaranteed unless expressly stated otherwise.

Orders typically require processing before shipment. Current estimated processing and delivery times are displayed on the product page, during checkout, or in our Shipping Policy.

Delivery may be affected by circumstances outside our reasonable control, including:

  • Carrier delays.

  • Customs inspections.

  • Import processing.

  • Weather events.

  • Public holidays.

  • Transportation disruptions.

  • High-demand periods.

  • Incorrect or incomplete addresses.

  • Failed delivery attempts.

  • Events of force majeure.

You are responsible for providing a complete and accurate delivery address.

Grufo is not responsible for delays or additional costs caused by incorrect, incomplete, or outdated information supplied by the customer.

When tracking information is available, it will be sent to the email address associated with the order.

Tracking updates are provided by shipping carriers and may not update immediately after a package is dispatched.

You are responsible for monitoring tracking information and making reasonable arrangements to receive the package.

Depending on the destination country, customers may be responsible for customs duties, import taxes, brokerage charges, or other fees imposed by local authorities.

Grufo does not control these charges and cannot guarantee the amount that may be assessed.

Risk of loss will be handled in accordance with applicable consumer law. Nothing in these Terms transfers risk to a consumer earlier than permitted by mandatory law.

If a package is marked as delivered but cannot be located, contact us promptly at hellogrufo@gmail.com so we can review the available tracking information.

SECTION 6 — INTELLECTUAL PROPERTY

The Services and their contents are owned by or licensed to Grufo and are protected by applicable intellectual property laws.

Protected materials may include:

  • The Grufo name.

  • The official Grufo logo.

  • Grufo’s character design and visual identity.

  • Product photographs.

  • Videos and animations.

  • Illustrations.

  • Text and product descriptions.

  • Graphics and advertisements.

  • Website designs and layouts.

  • Audio.

  • Reviews and curated content.

  • Slogans, names, and branding elements.

You may access and use the Services only for personal, lawful, and non-commercial purposes.

Without our prior written permission, you may not:

No provision of these Terms grants you ownership of or a license to Grufo’s trademarks, copyright, product designs, branding, or other intellectual property except for the limited personal use expressly permitted by these Terms.

The Shopify name, logo, products, and services are trademarks or intellectual property of Shopify.

Other names, logos, products, and trademarks appearing through the Services belong to their respective owners.

All rights not expressly granted are reserved.

SECTION 7 — OPTIONAL TOOLS AND SERVICES

The Services may provide access to tools, applications, payment methods, tracking systems, social media features, or other services operated by third parties.

We do not necessarily control, monitor, or manage those third-party tools.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

Grufo is powered by Shopify, which provides the e-commerce platform that enables us to offer the Services.

Purchases made through our store are transactions directly between you and Grufo.

Shopify is not the seller of Grufo products and is not responsible for the fulfillment, quality, delivery, return, refund, warranty, or suitability of products purchased from Grufo.

To the fullest extent permitted by applicable law, you acknowledge that Shopify and its affiliates are not liable for claims, losses, damages, or disputes arising from transactions made directly with Grufo.

Nothing in this section limits rights that cannot legally be waived or excluded.

SECTION 10 — PRIVACY POLICY

Certain information may also be processed by Shopify in accordance with Shopify’s own privacy policies.

  • Display.

  • Promote.

  • Create derivative materials from the Feedback.

This permission includes use for operating, improving, marketing, and promoting Grufo and the Services.

You represent and warrant that:

  • You own the Feedback or have permission to submit it.

  • The Feedback is accurate and not misleading.

  • The Feedback does not violate intellectual property, privacy, publicity, contractual, or other rights.

  • You have disclosed any payment, free product, discount, or other incentive received in connection with the Feedback.

  • The Feedback complies with applicable law and these Terms.

We are not obligated to:

  • Keep Feedback confidential.

  • Compensate you for Feedback.

  • Publish Feedback.

  • Respond to Feedback.

  • Retain Feedback permanently.

We may monitor, edit, reject, or remove Feedback that we reasonably determine is unlawful, fraudulent, offensive, abusive, threatening, defamatory, obscene, misleading, or otherwise violates these Terms.

  • Respect security measures and automated access controls.

  • Avoid circumventing CAPTCHAs or other human-verification systems.

  • Avoid misrepresenting automated activity as human activity.

  • Stop accessing the Services when requested.

Nothing in this section authorizes scraping, copying, extraction, or commercial use of Grufo content.

  • Feedback.

  • Payment obligations.

  • Disclaimers.

  • Limitation of liability.

  • Indemnification.

  • Governing law.

SECTION 16 — DISCLAIMER OF WARRANTIES

The Services and general information provided through them are made available for informational and commercial purposes.

We do not guarantee that all website information will always be complete, current, uninterrupted, secure, or error-free.

This may include, where legally permitted:

  • Lost profits.

  • Lost revenue.

  • Lost savings.

  • Loss of data.

  • Loss of opportunity.

  • Replacement costs.

  • Business interruption.

These limitations apply regardless of whether the claim is based on contract, negligence, tort, strict liability, statute, or another legal theory.

Nothing in these Terms excludes or limits liability when exclusion or limitation is prohibited by law, including liability that may arise from:

  • Fraud.

  • Intentional misconduct.

  • Gross negligence where it cannot be excluded.

  • Death or personal injury where liability cannot legally be excluded.

  • Mandatory consumer protection rights.

Where liability cannot be fully excluded, it will be limited to the maximum extent permitted by applicable law.

  • Your violation of another party’s rights.

  • Feedback or content submitted by you.

  • Fraudulent or malicious activity conducted through your account.

This obligation will not apply to the extent a claim was caused by Grufo’s own unlawful conduct, negligence, or breach of these Terms.

We will provide reasonable notice of an indemnifiable claim and may participate in or control its defense, subject to applicable law.

SECTION 19 — SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law.

The unenforceable portion will be treated as severed, and the remaining provisions will continue in effect.

You may not assign or transfer your rights or obligations under these Terms without our prior written permission.

We may assign or transfer these Terms, or our rights and obligations under them, as part of a merger, acquisition, restructuring, sale of assets, corporate reorganization, or transfer of the Grufo business.

Any assignment will remain subject to applicable law and will not reduce mandatory consumer rights.

These Terms and any separate agreements through which we provide the Services will be governed by the laws applicable in the jurisdiction where Grufo is legally established, without regard to conflict-of-law principles.

However, if you are a consumer, nothing in this section deprives you of mandatory protections available under the laws of the country or region where you ordinarily reside.

Any dispute will be submitted to the courts with jurisdiction under applicable law.

Nothing in these Terms prevents either party from using a legally available consumer complaint, mediation, or alternative dispute resolution process.
